By accessing or using Nailify ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. Nailify is operated by an individual based in Sydney, Australia.
2. Description of Service
Nailify is an AI-powered nail design generation platform. Users upload hand photos, select style preferences, and receive AI-generated nail design images. The Service is provided on a credit-based model.
3. Account Registration
You must create an account to use Nailify. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when registering.
4. Credits and Payments
- New accounts receive 5 free generation credits.
- Additional credits can be purchased via the credit packages listed on the site.
- Credits are non-refundable and do not expire.
- All payments are processed securely by Stripe.
- Prices are listed in USD and may be subject to applicable taxes.
5. Refund Policy
Credits are generally non-refundable once purchased. If you experience a technical issue that prevents the Service from functioning (e.g., a generation failure that incorrectly deducted a credit), please contact us and we will review the case individually.
6. Acceptable Use
You agree not to:
- Upload images that contain nudity, explicit content, or images of minors.
- Use the Service for any unlawful purpose.
- Attempt to reverse engineer, scrape, or abuse the Service or its APIs.
- Resell or redistribute generated images as AI-generated content without disclosure.
- Use automated tools to generate images at scale without prior written permission.
7. Intellectual Property
You retain ownership of the photos you upload. The AI-generated images produced by Nailify are provided to you for personal use. Nailify retains the right to use anonymized generation data to improve the service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind. AI-generated nail designs are for visualization purposes only and may not perfectly represent real-world results. We do not guarantee the accuracy, quality, or fitness of any generated image for a particular purpose.
9. Limitation of Liability
To the fullest extent permitted by law, Nailify and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 30 days prior to the claim.
10. Termination
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time by contacting us.
11. Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will update the "Last updated" date at the top of this page.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the jurisdiction of the courts of New South Wales.
